Limits of Liability

Liability
Liability for loss, delay, or damage to baggage will be limited as indicated below, unless a higher valuation for checked baggage has been declared and additional charges paid at check-in. Excess valuation may not be declared on certain types of articles. Please see Additional Insurance
No Liability for:
- Fragile items
- Perishable items
- Previously damaged baggage
- Oversized, overweight or overpacked baggage
- Minor damage such as scratches, scuffs, dents, cuts and dirt resulting from normal wear and tear
- Any damage resulting from Transportation Security Administration (TSA) inspections
- Infant/child restraint devices (devices include, but are not limited to, strollers and car seats)
- Any damage to checked musical instruments not presented in a hard-sided case. If the outside of the hard-sided case does not have visible damage no liability for any damage to the musical instrument inside the case.
- Any damage to sports items not presented in a hard-sided case. If the outside of the hard-sided case does not have visible damage, no liability for any damage to the sports item inside the case.
Travel Wholly within the 50 States of the United States, Puerto Rico and the U.S. Virgin Islands
- Liability is limited to $3000 per ticketed passenger for travel on or after February 28, 2007
- No liability for damage or loss of protruding baggage parts such as wheels, straps, pockets, pull handles, hanger hooks or other items attached to baggage
- No liability for baggage carried in the passenger cabin
- No liability for photographic equipment, computers, VCRs and any other electronic equipment including software or components, jewelry, cash, documents, furs, works of art or other similar valuable items
- Other items that are not covered in our limit of liability include, but are not limited to: antiques, books, china, fragile items, liquids, medicines, perishable items, securities and negotiable papers or silverware

International Destinations
For international travel (including United States domestic portions of international journeys) to which the Warsaw Convention applies:
Liability for loss, delay or damage to baggage is limited to approximately $9.07 per pound ($20 per kg) for checked baggage and $400 per passenger for unchecked baggage unless a higher value is declared in advance and additional charges are paid. Excess valuation may not be declared on certain types of valuable articles. Under no circumstances will the carriers be liable for the loss, delay, or damage to unchecked baggage or cabin baggage not attributed to the negligence of the carrier.
Liability is for a maximum of 70 lbs/32 kgs ($634.90) per checked bag. This limit may be lowered for additional pieces to certain international destinations or when using connecting carriers.
For international travel (including United States domestic portions of international journeys) to which the Montreal Convention applies:
Liability for loss, delay or damage to baggage is limited to 1,000 Special Drawing Rights regardless of the number of bags a passenger may check. Exchange rates are available on-line at www.IMF.org.*

International Travel
Liability limitations for travel to/from international destinations for all airlines are governed by the Warsaw Convention or Montreal Convention, as applicable. A copy of these documents may be obtained at your local library or on-line at www.ICAO.org.*

Additional Insurance
|
If you are traveling with items valued beyond the standard baggage liability allowance, you may decide additional insurance is necessary. Here are a few guidelines:
- Excess valuation insurance covers loss of the baggage; it does not cover damage to the bag or its contents
- Excess insurance may not be purchased for items excluded from our liability; such as jewelry, cash, computers, etc. Please see Limits of Liability for details.
- Additional insurance may be purchased when you are checking your baggage at any airport ticket counter. Skycaps are not able to offer excess valuation insurance.
- If your itinerary involves more than one airline, it is important to remember that excess value insurance must be purchased from each carrier, and only applies to the carrier it was purchased from. It will be necessary to claim your luggage at the connecting city, recheck and insure the bags with the other carrier.
Rates
The charge for excess valuation insurance for checked baggage is assessed at a rate of $2.00 USD per each one hundred dollars purchased. The total valuation on your checked luggage may not exceed $5,000 USD per passenger. The total valuation of $5,000 includes the standard baggage liability allowance + excess valuation insurance purchased.
